Question:
I have been told that some manufacturers will void their warranty if their specific underlayment is not used. How can I deal with this? |
Answer:
The answer is two-fold. First, Diversified Foam Products, Inc. is so confident in the physical properties and the performance of The Floor Muffler that we agree in our warranty that “Should any manufacturer of these types of floors fail to honor their warranty due to the installation of FloorMuffler rather than their brand of underlayment, we will agree to honor their original warranty in full should FloorMuffler fail in any way.”
Secondly, the Federal Trade Commission, through the Magnusson-Moss Act, has deemed this illegal in their “Tie-In Sales Provision”. (Please refer to www.ftc.gov/bcp/conline/pubs/buspubs/warranty.htm for complete details.) In essence however, the following is a summary from the Act:
"Tie-In Sales" Provisions
Generally, tie-in sales provisions are not allowed. Such a provision would require a purchaser of the warranted product to buy an item or service from a particular company to use with the warranted product in order to be eligible to receive a remedy under the warranty. The following are examples of prohibited tie-in sales provisions.
In order to keep your new Plenum Brand Vacuum Cleaner warranty in effect, you must use genuine Plenum Brand Filter Bags. Failure to have scheduled maintenance performed, at your expense, by the Great American Maintenance Company, Inc., voids this warranty. Back to Top |
